1. Introduction and acceptance

These Terms & Conditions ("Terms") govern your access to and use of the website https://www.bearwithmespanish.com and the language-learning services offered by Miguel Bear Niño, operating as Purposeful Spanish ("Purposeful Spanish," "we," "us," or "our").

 

By creating an account, purchasing a plan, booking a class, or otherwise using our services, you ("you," "Student," or "Client") agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use our services.

2. Definitions

  • Services — the online Spanish-language instruction and related content offered by Purposeful Spanish, including individual (1:1) classes, group classes, and the Purposeful Spanish program.

  • Instructor / Teacher — any teacher who provides classes through Purposeful Spanish, whether the founder or an additional instructor engaged now or in the future.

  • Membership / Plan — a recurring subscription that grants access to a set number of classes per billing cycle.

  • Billing cycle — the recurring period on which your Membership is charged (currently a 4-week cycle unless stated otherwise on the plan).

  • Session — a single scheduled class.

3. Description of the Services

Purposeful Spanish offers Spanish-language instruction with a Christ-centered, biblical focus. Classes are designed to grow the Student both in the Spanish language and in their faith, and may include prayer, a daily devotional, and Bible reading in Spanish.

 

3.1. Format. Classes are offered as individual (1:1) sessions and, where available, group sessions, delivered online via third-party video tools (e.g., Zoom or Google Meet).

 

3.2. Faith-based content — please note. By enrolling, you acknowledge and consent that the Services intentionally include Christian devotional content. This content is a core part of the program and is not incidental. If this is not what you are looking for, the Services may not be a good fit for you.

 

3.3. No guarantee of results. Language learning depends on many factors, including your own participation and practice. We do not guarantee any specific level of fluency, proficiency, exam result, or outcome.

4. Eligibility and minors

4.1. You must be at least 18 years old to create an account and purchase a Membership.

 

4.2. Students under 18 may participate only with the verifiable consent and supervision of a parent or legal guardian, who must create and hold the account, accept these Terms on the minor's behalf, and remain responsible for all activity and payments. By enrolling a minor, you confirm you are their parent or legal guardian.

 

4.3. Given the faith-based nature of the Services, a parent or guardian enrolling a minor consents to the Christian devotional content described in Section 3.2.

5. Accounts and registration

You agree to provide accurate, complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your account and for all activity under it. Notify us promptly of any unauthorized use.

6. Memberships, pricing, and payments

6.1. Recurring billing. Memberships are subscriptions that renew automatically at the end of each billing cycle (currently every 4 weeks) using your saved payment method, until cancelled in accordance with Section 7.

 

6.2. Prices. Current prices are shown on the website at the time of purchase and are in U.S. dollars (USD) unless stated otherwise. We may offer different pricing to different Students (for example, legacy pricing for existing Students or promotional discounts); the price applicable to you is the price shown or agreed at your checkout.

 

6.3. Price changes. We may change prices for future billing cycles. We will give you reasonable advance notice, and changes will not affect a cycle you have already paid for. Continuing your Membership after the change takes effect constitutes acceptance of the new price.

 

6.4. Payment processing and fees. Payments are processed by third-party providers (including through the Wix platform and its payment partners). Applicable platform or transaction fees, and any taxes, may apply. We are not responsible for errors caused by third-party payment processors.

 

6.5. Failed payments. If a scheduled payment fails, we may suspend access to classes until payment is resolved and/or cancel the Membership.

7. Cancellation, rescheduling, makeups, and refunds

7.1. Your weekly slot. For recurring classes, you select a preferred day and time, which we may set as a recurring weekly appointment for the cycle. That becomes your reserved slot.

 

7.2. Rescheduling and cancellations of a single class. Please reschedule or cancel a class at least 24 hours in advance. Classes cancelled with 24+ hours' notice may be made up within the same billing cycle, subject to Instructor availability.

 

7.3. Late cancellations and no-shows. A class cancelled with less than 24 hours' notice, or a no-show, counts as a completed class and is not eligible for a makeup or refund.

 

7.4. Makeups. Makeup classes must be used within the current billing cycle and do not roll over to future cycles. We allow up to 1 makeup per cycle.

 

7.5. Cancelling your Membership. You may cancel your Membership at any time before your next renewal date. Cancellation stops future charges; your access continues until the end of the cycle you have already paid for.

 

7.6. Refunds. Except where required by law, payments are non-refundable, including for unused classes in a cycle. 

 

7.7. Group classes. Group classes may have minimum enrollment requirements and specific schedules. If we cancel a group session for lack of enrollment or other reasons, we will offer a makeup, credit, or reschedule where reasonable.

8. Instructors

8.1. Instructor assignment. Classes may be taught by the founder or by other Instructors engaged by Purposeful Spanish. We may assign or reassign your Instructor, including if an Instructor becomes unavailable, while making reasonable efforts to maintain continuity.

 

8.2. Independent contractors. Instructors may be independent contractors rather than employees. Regardless of who teaches a class, your agreement for the Services is with Purposeful Spanish, and these Terms govern that relationship.

 

8.3. Substitutions. In the event of illness, emergency, or scheduling conflicts, we may provide a substitute Instructor or reschedule the affected class.

9. Student conduct

You agree to treat Instructors and other Students with respect and to maintain a courteous learning environment consistent with the values of the program. We may suspend or terminate access, without refund, for abusive, disruptive, illegal, or harassing behavior.

10. Intellectual property

10.1. All course materials, lesson content, devotionals, curricula, text, graphics, logos, and the "Purposeful Spanish" name and branding are owned by or licensed to us and are protected by intellectual-property laws.

 

10.2. Materials are provided for your personal, non-commercial learning use only. You may not copy, record, redistribute, resell, publicly share, or create derivative works from them without our prior written permission.

 

10.3. Bible passages and third-party devotional materials remain the property of their respective rights holders and are used within the Services for educational and devotional purposes.

11. Recording of classes

You may not record (audio or video) any class without the prior consent of the Instructor and any other participants. We may record sessions only with appropriate notice and consent, for example for quality or training purposes.

12. Third-party services

The Services rely on third-party platforms (for example, Wix for the website and payments, and Zoom or Google Meet for video). Your use of those platforms is subject to their own terms and privacy policies. We are not responsible for the availability, performance, or acts of third-party services.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review it.

14. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and any guarantee of specific learning outcomes, uninterrupted access, or error-free operation.

15. Limitation of liability

To the fullest extent permitted by law, Purposeful Spanish, its owner, and its Instructors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits, arising from your use of the Services. Our total aggregate liability for any claim relating to the Services will not exceed the amount you paid to us in the three 2 months preceding the event giving rise to the claim.

16. Indemnification

You agree to indemnify and hold harmless Purposeful Spanish, its owner, and its Instructors from any claims, damages, liabilities, and expenses arising out of your use of the Services or your breach of these Terms.

17. Suspension and termination

We may suspend or terminate your access to the Services, with or without notice, for breach of these Terms, non-payment, or conduct that harms other users, our Instructors, or the program. You may stop using the Services at any time by cancelling your Membership.

18. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

19. Governing law and disputes

These Terms are governed by the laws of Mexico, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the courts located in the courts of Mexico City, Mexico, unless otherwise required by applicable law.

All content on the Site — including the "Purposeful Spanish" name, logo, branding, text, graphics, images, lesson descriptions, devotionals, and design — is owned by or licensed to Miguel Bear Niño and is protected by applicable intellectual-property laws.

 

You may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content without our prior written permission, except for normal personal viewing of the Site. Bible passages and third-party materials remain the property of their respective rights holders.

5. Liability for content

We take reasonable care to keep the information on the Site accurate and up to date. However, we do not warrant that Site content is complete, current, or error-free. Information on the Site is provided for general purposes and may change without notice. To the fullest extent permitted by law, we are not liable for any loss or damage arising from reliance on Site content.

6. Availability of the Site
